Terms of Service
Ponthier & Son Pressure Washing LLC ("Company," "we," "us," or "our") provides pressure washing and exterior cleaning services subject to the following Terms of Service. By requesting a quote, booking services, or allowing us to perform work on your property, you ("Customer") agree to be bound by these terms.
1. Scope of Services
The Company agrees to provide pressure washing, soft washing, and/or sealing services as described in the estimate provided to the Customer. The specific surfaces to be cleaned and methods to be used will be detailed in the work agreement. Services are performed at the address provided by the Customer during the quote request.
2. Estimates & Pricing
All estimates provided by the Company are based on:
- The Customer's description of the property and surfaces to be cleaned
- Visual assessment when performed on-site
- Standard cleaning scope
Final pricing may be adjusted if:
- The actual scope of work differs from the description provided
- Additional surfaces or services are requested
- Unexpected conditions are discovered that require additional time, equipment, or materials
The Company provides written estimates prior to work commencing. The Customer agrees to review and approve the estimate before work begins.
3. Payment Terms
Deposit: A deposit may be required to schedule services. The deposit amount will be specified in the work agreement and is non-refundable for cancellations made less than 48 hours before scheduled service.
Final Payment: The balance is due upon completion of services, unless otherwise agreed in writing.
Accepted Payment Methods: Cash, Check, Credit Card
Late Payment: Accounts more than 30 days past due may be subject to a late fee of 1.5% per month on the outstanding balance.
4. Property Conditions & Pre-Existing Damage
Customer Responsibility: The Customer is responsible for informing the Company of any pre-existing damage, defects, or conditions affecting the surfaces to be cleaned, including but not limited to:
- Loose or cracked mortar
- Damaged siding or roofing materials
- Loose paint or stucco
- Water intrusion issues
- Areas with compromised structural integrity
- Surface defects or previous repairs
Waiver of Claims
The Customer acknowledges that pressure washing and soft washing involve high-pressure water and/or cleaning solutions. While the Company uses professional techniques and appropriate pressure settings for each surface, certain pre-existing conditions (including but not limited to loose mortar, aging paint, weakened wood, or cracked surfaces) may be affected by the cleaning process.
The Company shall not be held liable for damage resulting from pre-existing conditions that were not disclosed by the Customer or were not visible during a reasonable inspection.
5. Water Intrusion Disclaimer
Pressure washing and soft washing may result in water intrusion if:
- Windows, doors, or other openings are not properly sealed
- There are gaps in siding, roofing, or exterior walls
- Electrical fixtures or ventilation openings are not adequately protected
- Chimneys or roof penetrations have compromised seals
Customer Responsibility for Water Intrusion
The Customer agrees to secure and protect:
- All windows and doors (closed and locked)
- Electrical outlets and fixtures (covered or turned off)
- Ventilation openings
- Any areas susceptible to water entry
The Company is not responsible for water intrusion caused by existing deficiencies in the property's weatherproofing, inadequate seals, or pre-existing vulnerabilities.
6. Landscaping & Property Protection
The Company takes reasonable precautions to protect landscaping, lawns, and exterior property features. However:
The Customer agrees to:
- Move or protect vulnerable items (decorations, patio furniture, potted plants, etc.)
- Mark underground utilities or irrigation lines
- Secure pets indoors during service
- Provide clear access to all work areas
The Company shall not be liable for damage to:
- Landscaping if access was restricted or hazards were not disclosed
- Items that were not moved as requested
- Property that was not reasonably accessible
7. Chemical Use & Soft Washing
The Company may use environmentally safe cleaning solutions, including sodium hypochlorite-based products, for soft washing and surface preparation. These solutions are industry standard and are applied according to manufacturer specifications.
Customer Responsibility Regarding Chemical Use:
- Inform the Company of any allergies or chemical sensitivities
- Keep people, pets, and plants away from treated areas during and immediately after service
- Avoid contact with treated surfaces until dry
The Company is not responsible for reactions in individuals with undisclosed chemical sensitivities.
8. Cancellation Policy
Customer Cancellation:
- Cancellations made more than 48 hours before scheduled service: Deposit refunded in full
- Cancellations made less than 48 hours before scheduled service: Deposit retained as a cancellation fee
- Cancellations on the day of service: Full cost of services may be charged
Company Cancellation: The Company reserves the right to cancel or reschedule services due to:
- Weather conditions (including rain, lightning, extreme heat, or high winds)
- Equipment failure
- Access issues or unsafe conditions
- Any condition that makes service delivery unsafe or impractical
9. Limitation of Liability
To the maximum extent permitted by Florida law:
The Company's liability is limited to the total amount paid by the Customer for services rendered.
The Company shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of use of property
- Damages from pre-existing conditions
- Damages from water intrusion through existing vulnerabilities
- Damages from acts of nature
- Damages from third-party actions
10. Insurance Disclosure
Ponthier & Son Pressure Washing LLC maintains:
- General liability insurance
- Workers' compensation insurance (as required for businesses with 4+ employees)
- Commercial auto insurance
Certificates of Insurance are available upon request. The Customer acknowledges that the Company's insurance coverage meets industry standards and is adequate for the services provided.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action arising from these terms or the services provided shall be brought exclusively in the courts located in Marion County, Florida.
12. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms of Service, together with the work estimate and any other written agreements signed by both parties, constitute the entire agreement between the Customer and the Company.
14. Amendments
The Company reserves the right to update these Terms of Service. The current version will be available on our website.
